Canadian employers can hire foreign workers when it will not negatively affect employment of Canadians and Permanent Residents, or when there are significant benefits to the recruitment of a foreign worker

If you want to visit Canada most likely you will need a visitors visa to enter. There are however a number of countries, citizens of which do not require a visitors visa to enter Canada. For example, if you are from the United States, you will not require a visa, but if you live in the Philippines or Russia, or Zimbabwe, the citizens of these countries must obtain a visitors visa to enter Canada.

If you are otherwise inadmissible but have a reason to travel to Canada that is justified in the circumstances, you may be issued a temporary resident permit. To be eligible for a Temporary Resident Permit, your need to enter or stay in Canada must outweigh the health or safety risks to Canadian society, as determined by an immigration or a border services officer. Even if the reason you are inadmissible seems minor, you must demonstrate that your visit is justified.

Parents and grandparents of Canadian citizens and permanent residents may apply for Super Visa. It is a temporary resident permit that allows a parent or grandparent to remain in Canada for up to 24 months at a time and it is renewable for five times.

As of November 9, 2016, travellers with passports from eTA-required counties; visa-exempt foreign nationals who enter Canada by air will need an Electronic Travel Authorization (eTA). Exceptions include U.S. Citizens, and travellers with a valid Canadian visa.

Express Entry is the new selection system for Canadian immigration, designed to select skilled workers for immigration to Canada. Express Entry is a completely electronic process involving the federal government, provincial governments, and Canadian employers. We help many Canadians sponsor family members. There are many different rules and procedures regarding sponsorships. We help our clients through the complicated process. We assist applicants with the choice of where best to apply and work with them throughout the process to ensure the best results. Canadian Citizens and Permanent Residents of Canada, residing in Canada, 18 years of age or older,  are allowed to sponsor their family members residing abroad to come join them in Canada. According to the Immigration and Refugee Protection Act, a foreign national is a member of the Family Class, if, with respect to a Canadian Sponsor, the foreign national is:

  • Sponsor’s spouse (including same-sex spouses), common-law or conjugal partner 16 years of age or older;
  • Sponsor’s parent or grandparent;
  • Sponsor’s dependent child, including adopted children;
  • Sponsor’s child under 18 years of age whom the sponsor intends to adopt;
  • Sponsor’s orphaned brother, sister, nephew, niece or grandchild under the age of 18 and not married or in a common-law relationship; or
  • Sponsor’s relative of any age if the sponsor does not have an aunt, uncle or family member from the list above whom he could sponsor or who is already a Canadian Citizen, Indian or Permanent Resident.

A Canadian Sponsor willing to bring his or her parents to Canada, must meet the LICO (Low Income Cut Off) requirements in order to be found eligible to sponsor family members. Canadian Sponsor undertakes to provide for the parents for the period of twenty years.

A Canadian sponsor willing to bring his or her foreign spouse or dependent child to Canada, is exempt from financial requirements and undertakes to provide for such sponsored family member for the period of 3 (three) years commencing from the date of sponsored family member’s arrival to Canada.  A Canadian Citizen of Permanent Resident may sponsor to Canada his same- sex conjugal partner, in case the couple is not married.

Entrepreneur Start-Up Visa Program

The Start-Up Visa program grants permanent residence to immigrant entrepreneurs while assisting them to become established in Canada.  The program encourages immigrant entrepreneurs to grow their companies in Canada. Successful applicants link with private sector organizations in Canada, where they can receive funding, guidance and expertise in opening and operating their enterprise in Canada.

The government of Canada, as well as the government of the province of Quebec, provide immigration programs for individuals who are self-employed in certain industries.

Federal Self-Employed Persons Program

To qualify for business immigration to Canada under the Self-Employed Persons Program, an applicant must demonstrate that he or she has relevant agricultural, artistic, or athletic experience that will allow the applicant to be successfully self-employed in Canada and to make a significant contribution to his or her field.

Canada has recognized this basic human right since 1951 when it signed the Convention relating to the Status of Refugees (the Geneva Convention). The right to life, liberty and security of the person is also enshrined in the Canadian Charter of Rights and Freedoms.

To be granted asylum in Canada as a refugee, a person must be outside his or her home country and have a well-founded fear of persecution. According to the Geneva Convention, the fear must not only be well-founded, the persecution must also be based on reasons of race, nationality, membership of a particular social group or political opinion. However, a less restrictive interpretation of the feared persecution may also lead to refugee status. For example, Canada recognizes that women can be persecuted because of their gender and that the definition of a refugee should be interpreted to also include this form of persecution. A variety of circumstances can make a person a refugee.

An H&C application is used in special circumstances to ask the government for permission to stay in Canada based on Humanitarian and Compassionate (H&C) grounds. The general rule under immigration law is that people apply for permanent residence from outside of Canada. With an H&C application, you are asking the government to make an exception to this rule and allow you to apply from within Canada. If you are in Canada with temporary status or you do not have valid immigration status, an H&C might be one of your only options for staying in the country.

The Home Child Care Provider Pilot and the Home Support Worker Pilot are 5-year pilot programs that let qualified caregivers and their family members come to Canada with the goal of becoming permanent residents.

If you’ve been offered a job in Canada as a caregiver or have experience working in Canada as a caregiver, you may be able to apply for permanent residence through one of these pilots.

The application process will be different depending on your situation and how much qualifying work experience you have.

OTHER SERVICES

The application process to renew a PR Card for Canada requires individuals to file form IMM 5444 and submit the required documents in order to replace the card that has expired or will soon expire. Lost, stolen, destroyed or expired immigration documents issued by the Government of Canada can be replaced. To have a PR Card renewed, individuals must complete an application and pay the applicable processing fee.

Documents required with your application:

  • Your Permanent Resident Card (if your card has expired). If it is due to expire, you can keep it with you and return it to the IRCC (formerly known as CIC) officer at a local IRCC (formerly known as CIC) office when you go to collect your new card.
  • A copy of your valid passport or travel document, or a copy of the passport or travel document you held at the time you became a permanent resident. Please note that if photocopies are not clear, your application will be returned to you.
  • Consult the Photo Specifications Appendix in the guide for more information. If your photos do not meet the requirements, they will not be accepted.
  • Any other identity documents specified in the Document Checklist (which will be part of the application kit).
  • should not be convicted of an offense related to the misuse of a Permanent Resident Card.

Canada offers citizenship through naturalization and by birth in Canada. Applications and processing times for a citizenship certificate and a list of documents accepted as proof of Canadian citizenship.

  • 18 years old or older
  • must have been physically present in Canada as a permanent resident for at least 1,460 days during
  • the six years immediately before the date of your application
  • must also be physically present for at least 183 days during each of four calendar years

  • Not be under a removal order
  • Not have a criminal prohibition
